OVERVIEW

This website is operated by Luminance Autowerke. Throughout the site, the terms "we", "us", and "our" refer to Luminance Autowerke.

By accessing our website, purchasing products, requesting services, or otherwise engaging with Luminance Autowerke, you agree to be bound by these Terms of Service, our Privacy Policy, Returns Policy, and any additional policies referenced herein.

If you do not agree to these Terms, you must not use this website or purchase our products or services.

We reserve the right to amend these Terms at any time. Continued use of our website or services following any changes constitutes acceptance of those changes.


SECTION 1 – ELIGIBILITY

You must be at least 18 years of age to purchase products or services from Luminance Autowerke.

By placing an order, you warrant that:

  • You are legally capable of entering into binding contracts;

  • All information supplied by you is accurate and complete;

  • You have authority to use the payment method provided.


SECTION 2 – AUTOMOTIVE PRODUCTS

Luminance Autowerke supplies automotive lighting products, retrofits, modifications, custom fabrication services, coding services, and related accessories.

Unless expressly stated otherwise in writing:

  • Products may be intended for off-road, show, motorsport, exhibition, or private property use only.

  • Products may not comply with ADR, DOT, ECE, roadworthy, registration, insurance, or other regulatory requirements.

  • The customer is solely responsible for determining the legality and suitability of any product for their vehicle and jurisdiction.

Luminance Autowerke accepts no responsibility for:

  • Defect notices;

  • Roadworthy failures;

  • Registration issues;

  • Insurance disputes;

  • Fines or penalties;

  • Vehicle compliance failures.


SECTION 3 – PRODUCT DESCRIPTIONS

We endeavour to ensure all product descriptions, specifications, images, colours, pricing, and availability information are accurate.

However:

  • Vehicle manufacturers may change specifications without notice;

  • Product colours may vary due to monitor settings;

  • Fitment may vary between production dates and regional models.

Customers are responsible for confirming compatibility before ordering.


SECTION 4 – CUSTOM ORDERS AND RETROFITS

Many products sold by Luminance Autowerke are:

  • Custom built;

  • Modified;

  • Retrofitted;

  • Made-to-order;

  • Special-order products.

Once work has commenced:

  • Deposits become non-refundable;

  • Labour charges become non-refundable;

  • Materials purchased for the project become non-refundable.

If an order is cancelled after work has commenced, Luminance Autowerke may retain all monies paid to cover labour, materials, administrative expenses, and project costs already incurred.


SECTION 5 – NO CHANGE OF MIND RETURNS

Due to the custom nature of our products and services, Luminance Autowerke does not accept returns, exchanges, or refunds for:

  • Change of mind;

  • Incorrect purchases;

  • Ordering errors;

  • Failure to read product descriptions;

  • Vehicle incompatibility where fitment information was available prior to purchase.

Nothing in this section limits rights available under Australian Consumer Law.


SECTION 6 – BENCH TESTING

All modified headlights, taillights, modules, and assemblies are bench tested before dispatch.

Luminance Autowerke may retain:

  • Photographs;

  • Videos;

  • Test records;

as evidence that products were functioning correctly prior to shipment.

These records may be relied upon in the assessment of warranty claims.


SECTION 7 – INSTALLATION REQUIREMENTS

Professional installation is strongly recommended.

The customer acknowledges that incorrect installation can cause:

  • Water ingress;

  • Electrical failure;

  • Vehicle damage;

  • Module failure;

  • Fire hazards;

  • Safety risks.

Luminance Autowerke shall not be liable for damage arising from:

  • Improper installation;

  • Incorrect wiring;

  • Incorrect coding;

  • Failure to waterproof components;

  • Vehicle electrical faults;

  • Third-party modifications;

  • Negligence or misuse.


SECTION 8 – VEHICLE CODING

Certain products may require:

  • Coding;

  • Programming;

  • Adaptation;

  • Calibration;

  • Vehicle software updates.

Any costs associated with these services remain the responsibility of the vehicle owner unless expressly included in writing on the invoice.

Luminance Autowerke does not guarantee compatibility with all vehicle software versions.


SECTION 9 – SHIPPING

Risk in goods passes to the customer upon delivery to the nominated shipping carrier.

Customers must inspect products immediately upon delivery.

Transit damage must be reported within forty-eight (48) hours of delivery and supported by photographic evidence.

Failure to report shipping damage within this timeframe may result in denial of the claim.


SECTION 10 – WARRANTY

Unless otherwise stated in writing, headlight retrofit services include a twelve (12) month limited warranty covering defects arising directly from workmanship performed by Luminance Autowerke.

This warranty:

  • Applies only to the original purchaser;

  • Is non-transferable;

  • Covers workmanship only.

Warranty claims must include:

  • Photographs;

  • Video evidence;

  • Proof of purchase.

Luminance Autowerke reserves the right to inspect and test all returned products before approving any warranty claim.


SECTION 11 – WARRANTY EXCLUSIONS

The warranty does not cover:

  • Improper installation;

  • Incorrect wiring;

  • Water ingress caused by installation errors;

  • Vehicle electrical faults;

  • Accidents;

  • Impact damage;

  • Physical abuse;

  • Misuse;

  • Negligence;

  • Unauthorised repairs;

  • Modifications performed by third parties;

  • Normal wear and tear;

  • Cosmetic damage occurring after delivery;

  • Damage caused during shipping after delivery;

  • Damage caused by natural disasters or extreme weather.


SECTION 12 – WARRANTY SHIPPING COSTS

For approved warranty claims:

Customers are responsible for:

  • Removal costs;

  • Installation costs;

  • Diagnostic costs;

  • Workshop labour;

  • Shipping costs to Luminance Autowerke.

Australian customers will receive return shipping at our expense following completion of approved warranty repairs.

International customers are responsible for all shipping costs unless otherwise agreed.


SECTION 13 – THIRD-PARTY COMPONENTS

Certain products may contain components supplied by third-party manufacturers.

Where a defect originates from a third-party component:

  • We will assist customers in obtaining support where possible;

  • Warranty coverage may be subject to the manufacturer's warranty terms.

We do not guarantee that third-party manufacturers will honour warranty claims.


SECTION 14 – LIMITATION OF LIABILITY

To the maximum extent permitted by law, Luminance Autowerke's total liability arising from any claim shall not exceed the amount paid by the customer for the relevant product or service.

Luminance Autowerke shall not be liable for:

  • Loss of profits;

  • Loss of income;

  • Loss of business;

  • Loss of opportunity;

  • Loss of vehicle use;

  • Towing costs;

  • Accommodation costs;

  • Workshop labour;

  • Hire vehicle costs;

  • Consequential losses;

  • Indirect losses.


SECTION 15 – CUSTOMER INDEMNITY

The customer agrees to indemnify and hold harmless Luminance Autowerke, its directors, employees, contractors, suppliers, and affiliates from any claim, demand, liability, damage, loss, cost, or expense arising from:

  • Improper installation;

  • Vehicle modifications;

  • Illegal use of products;

  • Breach of these Terms;

  • Misuse of supplied products.


SECTION 16 – INTELLECTUAL PROPERTY

All content on this website including:

  • Logos;

  • Product photographs;

  • Videos;

  • Graphics;

  • Product descriptions;

  • Branding;

remain the property of Luminance Autowerke unless otherwise stated.

No content may be copied, reproduced, or used without prior written permission.


SECTION 17 – TERMINATION

We reserve the right to refuse service, cancel orders, suspend accounts, or terminate access to our website at our sole discretion.

Any obligations incurred prior to termination survive termination.


SECTION 18 – GOVERNING LAW

These Terms of Service shall be governed by and construed in accordance with the laws of Victoria, Australia.

The parties submit to the exclusive jurisdiction of the courts of Victoria and the Commonwealth of Australia.


SECTION 19 – AUSTRALIAN CONSUMER LAW

Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy available under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law, or any other applicable legislation.

Where permitted by law, our liability is limited to:

  • Repair;

  • Replacement;

  • Re-supply;

  • Refund;

at our election.
